In many states, a disputed earnest money deposit on a contract involving realtors normally gets transferred to the Dept of State or whatever agency oversees real estate licensing. 

If he puts something on the MLS then he will have an agency relationship with the seller. 

Some agencies have agents start as Admins in the office and that could be an option as well.

I'm not sure where or who else to ask and as I'm sure you've all found out at some point or another speaking with any State or County agency can be hit or miss with a strong emphasis on miss. 

This is after the settlement statements are issued by title agency and it has nothing to do with something being out of order with the property that would cause the buyer to delay.
