So far it’s not entirely complicated, but there are definitely gaps in my understanding and it’s difficult to get the proper info from just web searching.I work a Full time (60 hours a week) job, but believe that I can still put in the proper due diligence and make good investments.

If you gave them the money and not the title company then you probably lost it and can try small claims.if its at the title company and its truly EM  then it takes your signature to release it.. so just don't sign. and work it out most of the time you guys will split it.. 

Web searching lead us further  into sketchy unanswered territory how the individual passed.   

Even if it's a reimbursement of the wholesaler's EM, deposit your EM with escrow and authorize release of the same amount back to the wholesaler.Don't pay the assignment fee until you've closed.
