I'm not an ERISA attorney, but I think this is a very clear example of what would be a prohibited transaction -- first, because it's your primary residence, and second, because you own the property in non-retirement vehicles.

To me, that is the real issue here.Personally, I would call the tenant and let them know that I know what they are doing and, assuming I have a subtenant prohibition in my lease, that they are violating the lease.

In the IRS lingo, it is called a "prohibited transaction" and can cause a collapse of your entire IRA.You may "borrow" your IRA funds for 60 days (there're rules to follow), but 2 months are usually two short to finish the rehab and sell the property - assuming it is a flip.
