Mark Forest is correct, you would make the current owner responsible for delivering the property to you vacant and empty of any chattels or property not explicitly itemised as being delivered with the property in the APS.We use attorneys for closing up here, but you would need either an attorney, title company or both to execute this on your own.It has also been our experience that FSBOs are usually over priced - sometimes those from other investors are close to reality, but not always.

@Brandon Heath Do check your local tenancy laws - California is known to do things a little differently.However, in many jurisdictions, when purchasing a property, you are permitted to request that the entire property, or a unit, be delivered to you vacant if you, or an immediate family member, plan to occupy it.

You may be able to get some history with name and birthdate and maybe a driver's license number but my immediate thoughts are that they are either hiding something or extremely paranoid, either way they are going to be a pain in the butt.I will not enter into a fiscal contract with and rent to anyone that I cannot verify who they are and do my due diligence on.

I can almost guarantee that no half-decent listing agent would recommend their client accept a contract where the EM wasn't delivered until 14 days after binding agreement.

Bao:Depending on the jurisdiction and the size of the building, if the resident tenant pool was terribly weak in comparison to the location, we would either walk or request the property be delivered vacant.
