I have a question about forming an LLC in Minnesota and am looking for some state specific feedback. 

Or will it not even matter because I should just buy the properties under an LLC.

I’ve got my accounts set up to send the money into a title company’s escrow account, and I’m in the process of setting up an LLC.

All the lenders I've spoken to want us to change title to the LLC members individual names.

However, this notion was struck down in court by the wording “beneficial” interest in mortgage and deed of trust documents.Bottom line there is nothing that a property placed in trust can do that a single member LLC can’t do cheaper, easier, and “cleaner”, in MOST cases.

The loan is in the LLC name with him as a personal guarantor.  

I also want to put the property into an LLC, but I've recently considered using the equity to pay off some personal Debt.Regardless of what I do with the equity, my first question is whether a HELOC or an equity loan would be the best option?

My wife and I sold a SFR that was in our names and did a 1031 into a commercial property in our LLC's name.
