In my market our contract says just because it is at the "end of it's useful life" but still is operable that is not something that can be renegotiated. 

John Underwood look at it this way, did you sign a contract with Homeaway to exclusively list on their site in return for a premiere listing?

I am working with a partner in Louisville, KY where we are under contract on a house, currently, trying to figure out how to make the deal work financially. 

When I go to look I bring a contract with me ready to put in the price .  

or get the property under contract in your own name and then create the trust / assign the contract to it?

So I have a property in contract and let me tell you,,,,,, this has been the most stressful thing I have ever encountered in my life !!!!!!!!

The listing agent will not release any financial info without a contract.

Quick update: we decided not to move into the bigger house in the burbs (it didn’t appraise and the seller wouldn’t come down) and are happily still living below our means.The Financial freedom that comes with living modestly is so sweet it will take a very special house to get us to move at this point.ALSO, similar townhome/same community as ours just sold for $30k MORE than what we had ours under contract for a month ago, so I feel like the low new house appraisal causing our deal to fall through was a blessing in disguise.
