It sounds like that is where title is today, it is not in the decedent, dead people can't own property.If the estate has been probated and an attorney was used, I would be surprised if that wasn't explained to the heirs.If your brother-in-law is an heir and he has judgements that would attach to any real property he owns, it quite possible the judgments have already attached, and any grantee would be taking title subject to them.As Tom Gimer intimated, you probably need the advice of a good real estate attorney licensed in the state where the property is.
