In this instance, If Timmy Tax Buyer during the course of his tax deed case, named and served Magnum Mortgage, that had a mortgage interest against the property in question, the interest of Magnum would be extinguished by the tax deed provided there were defects in notice to or service upon Magnum.

You're still going to have to try to locate the heirs and serve them with the complaint and in Virginia that's not particularly easy.

In fact, if the tenants aren't destroying the place, a good case could be made that the property is better served by having someone in it than having it abandoned, as empty houses don't fare well in the long term.

My question would be clarifying my understanding of the order about how a tenant has to serve the landlord with the declaration, and then the landlord could supposedly face fines and jailtime for continuing with the eviction.Then separately I read how courts would independently assess if the declaration actually held water.I wasnt sure if the criminal penalties are only for self-help evictions, which are already illegal, or theoretically could be applied just for filing the eviction even when i doubt the validity of the tenants declaration, even though apparently the courts are willing to look at the (civil) eviction case.This all really does feel like the legal version of the upside down in stranger things.
