Although the question is not very clear, yes the losses gets released and can offset your ordinary income unless you have done grouping election that can prevent the release of the suspended losses.

Every underwriter has their own required form.Not executing it (or striking out items, etc.) raises big red flags and does nothing to prevent the seller from being sued... by the buyer or the title company.
