Don't forget there are other provisions in 504B that by statute award reasonable attorney fees--unlawful ouster, etc.  

I think it is clear that doing something ex post is unethical, unlawful (conspiracy to defraud creditors or some such), pisses judges off, etc.The question is about the validity of doing it PRIOR to being served as a defensive mechanism/technique.

There is maipulation going on in the background: lawsuits, (can even be unlawful foreclosure), FDIC requirements & investigations, mortgage insurance processing, too many REOs at the bank, bankruptcies, contract requirements, change in department heads, change in policy mid sale and on and on.
