The agreement of forbearance or modification should have the borrowers knowledge that they are in default, that they understand that the lender is forgoing foreclosure at this time in exchange for the deed in lieu, and that the borrower is represented by legal counsel.  

Never pay an upfront fee.You didn’t mention your state but understand that with little exception, an NMLS registration is only required for consumer-purpose loans.

Instead, start by sharing why you’re interested and ask questions to understand the seller’s motivation like, ‘Why do you think it hasn’t sold yet?’

@Ryan Fox it's important to make sure you understand the pros and cons of rental arbitrage to see if it meets your personal investment and financial goals. 

The real skill is understanding the variability and risk in each number which is not always numerical or scientific.
