Most of your potential buyers will likley be using funding, wich means there's a potential you could not close in time if any problems were to arise during escrow,and, again this is assuming you get an offer within the first 45 days, then 30 days to "hopefully" close.

I think not.I like to step back in time in cases like this and think what people would have done back when Govt was small and stayed out of the way generally.....what would have happened to this landlord and this squatter back in, let's say 1600s England, or 1880s Arizona?

The issue was not the amount they agreed on, but that my mother was promised to be paid on the date of closing - But 2 days before closing my mom asked to know who the title company was (which they refuse to tell her) or about the Check she would be given, then the Investor turned the story around saying "there is no money yet, you'll be given it in time but no definitive date on when" which was definelty not what was agreed upon, the investor led my mom to believe she had the money waiting for, ready to be paid *On* closing date of February 12th.

Its' technically legal from what I've been told (check with a lawyer in your state), but there is a pretty precise science involved to make sure you do it all legally and avoid a due-on-sale-clause from the lender which, albeit unlikely, is happening especially in times like now wherein the interest rate difference between current rates and the loan you might be taking over can be significant.
