When we got our proof of funds letter from the hard money lender we literally turned it over and submitted it with all the contracts to our realtor, who then submitted it to the seller with our earnest deposit.

I am looking to send them a notice - should I get proof of delivery or signature on delivery ? 

My area is quite unique, constantly improving and almost recession proof due to proximity to big apple.  

I don't really have any evidence that they new about the leaks accept that I noticed the leaks for the first time after there was heavy rain within 2 months of buying the house, but now 11 months have passed since I purchased the house.If I was going to go forward with this I would just get a quote from a contractor on how much it would cost to fix it and bring that to court as the amount that I want to collect in damages.

He didn't ask me for proof of funds however.

I always collect one full month's rent first regardless of how many days they occupy the first month and then have them pay the pro-rated amount on the second month - it gets more skin in the game with the tenant. 

We liquidated two, got all our initial investment back, and have three reperforming notes left with a relatively high UPB, on which we plan to collect the entire amount.
