Hello, The current property owner has a mortgage with a regional bank.  They are willing to sell with owner financing.Will a bank ever allow this to happen if the bank doesn't get paid off at time of sale?  Thank you!

The mortgage servicer will not release this information to anyone but the borrower, and will often require a written authorization to release information signed by the borrower before they'll talk to you about the loan or the current balance.

And get a copy of ALL of his sub-contractor's WC policies as well.Finally, get a lien release from every sub before you give him/them their final check.That should do it... :-)

My state's contract has an assignability clause built in with 3 options:May not assignMay assign but buyer is still liable to uphold contract termsMay assign and be released from contract termsIt sounds like you don't know your state's Realtor contract, so you should definitely read it. 

I'd retro fit them to get a release in place.
