The only thing it does is weaken your negotiating position.I suspect that an attorney could use that to your advantage as there was no meeting of the minds, nor is there a contract in effect.One thing you might try is to send him a demand letter and have it served by a sheriff or constable, depending on how things are done in NC.  

I wouldn't try to serve a cease and desist to Checch and Chong directly. 

Apart from the ethics of serving my client’s best interest, by doing so my business grows and my own goals are met.

This was not part of the original deal borrowers signed up for, but when you take Uncle Sam's money, you play by HIS rules, and he's been known to change those rules at a whim to serve his interests.
