I called in favor from family to provide me with proof of funds to submit with offer, but I was putting up earnest, so if I ended up not closing, my family was not technically out anything, other than 10 minutes to email me a bank statement, which I blacked out the account number and address.

Best to talk to your loan officer as he knows all of the specifics not only of you for the approval but the lender you are being submitted to and their requirements.  

However what he said doesn't matter, what matters is the legal documents and application you signed.

In regards to signing a waiver (I am not a lawyer), I believe that unless you have a lawyer create the legal document, the waiver does not hold up in court.  

Take detailed photos of the damage and document all interaction with your landlord. 

Therefore, unless there was documentation separating it as a capital contribution or some other thing, it would be owned by all owners of the LLC. 

Also most folk simply don't understand buyer agency, so detailing it in a written agreement and explaining the document to the client helps them understand the relationship as well.
