The most obvious theories are "unfair and deceptive trade practices", the "implied warranty of merchantability" and "fitness for a particular purpose", but your attorney will know all that.I would push your attorney to pursue that avenue aggressively as it sounds like you'll have a very sympathetic face in front of a Magistrate.
