It is and always be an option to the mortgagee to use where the law allows and will be used where it benefits the mortgagee's interests in general not just with rate.If the Mortgagee calls the note due, then paying the Mortgagee satisfies the demand.

Your next best choice is to bring the loan current, if the bank will allow you to do so, and then proceed with the transaction, keeping in mind that you want to satisfy the "equity stripping" component (making sure the seller gets some money for the same two reasons I just stated.)
