One question I hadn't thought of for a development like this - how much does it cost to get an HOA going with all the legal paperwork and CCR's?

Big developers do this with land all the time, and I've never heard about any of them being prosecuted either.I'm just trying to familiarize myself with the laws and risks, so any references would be appreciated!
