I just bought a house in Ohio at auction the owner does not live there. and based on the court cases and back water bill I would say the tenant probably has not been paying rent.

The lease is setup so that each can be held individually responsible.Wife and husband use as primary residence, co-signed lives elsewhere.Husband and wife are divorcing.Wife is refusing to pay any portion of rent, so husband is paying 100%.Husband and co-signer are pleading for help to dissolve the lease so that husband doesn't have to pay 100% of rent anymore, and he can vacate the premises without any court involvement.Wife is refusing to cooperate and doesn't really want to move.Any ideas or feedback would be appreciated.Thank you.

An attorney will be able to advise the best type of legal structure to support what you want to do.You want everything to be done in writing and by an attorney, because in spite of what some people think something written on the back of an envelop isn't always going to stand up in court if their is legal president or law making something illegal and as a non lawyer you would have no way of knowing that. 2) You own the property, they carry the mortgage and note that is filed, just like with a bank.

If Ohio is anything like Michigan, and since I once worked in Ohio for a brief time I know it can be even worse, a judge may decide that foreclosure may be necessary even if the situation before the court does not meet the minimum length of time or buyer's equity rules.

I heard in the past that if you were requesting to lower it over a certain percentage, that you had to appear in court and the school board would be there to contest.

Unless you could find another contractor to explicitly say the previous one was negligent, you're probably out of luck taking them to small claims court.
