It's really difficult.Some attorneys will help with collections, but their results aren't great and you have to pay them for their time, whether they collect something or not.My suggestion is to turn this over to a collection agency.

-What are the experiences of the group in negotiating with the seller/agent to bring the price down because of this fact.....Do we hope to get all the way down to ACTUAL cash flow value?

Does this also mean “selling” the property to the LLC and paying capital gains tax?

Seems like this property is not really cash flowing on year 1 or 2 but there is a good potential for appreciation if I buy and hold.

What does this look like? 

I've only dealt with residential at this point but am looking into self storage and on my search for commercial I stumbled upon a car dealership property where the owner is moving out of state and motivated to sell the property.

This is high season in Western NC.
