Basically, the IRA is only prohibited from investing in collectibles (artwork, antiques, stamps, etc.) and life insurance.The key is that all such investments are done at arm's length and there be no nexus between the IRA and you or other disqualified parties to the IRA.

But then all we needed was the authorization form you speak of signed by seller... then off we went Never needed a title company.. we prepped our own deed got it signed walked it into the court house and recorded that sucker  LOL.. along with bringing the loan current last second.. lots of sad faces at the courthouse next day  :).But that's no legal these days ( well its legal) but there are a lot of rules that make this prohibitive practice in our area if you don't want to get into serious trouble with the regulators.

It’s a general, blanket UCC filing that doesn’t prohibit the acquiring or transfer of assets in the ordinary course of business.A loan amount of $25,000 or less is unsecured, and removes the Security Agreement and UCC filing, but loan proceeds usage requirements remain in place."

I just called my current mortgage holder, Citibank, and they informed me that I can get a HELOC opened for more money than I was anticipating, BUT that using that money for real estate was prohibited.

Clarifying servicers’ obligations to avoid dual-tracking and prevent wrongful foreclosures: The CFPB’s existing rules prohibit servicers from taking certain actions in foreclosure once they receive a complete loss mitigation application from a borrower more than 37 days prior to a scheduled sale.
