Take a listen to the podcasts, they have been a good source to get the creative juices flowing to overcome hurdles.  

There are 2 camps basic camps of naysayers; 1) those who are risk adverse, 2) those who are jealous.  

Probably the first thing you will think of is adverse possession. 

Sure you could, there are only two hudles to overcome.

Setting aside that it is premature at this point, ultimately if it came down to it, it may make sense to pay the debt to avoid any adverse credit consequences and then at that point sue to get it back.
