If he doesn't come up to speed on investing, I predict he will hold you back and your marriage will end in divorce anyways, costing you money along the way. 

But we believe the very likely returns in real estate are higher and more predictable than the way it's currently invested in stocks.

You can't predict the future, but you can at least see what assessment the property is subject to today.

I don't think anybody predicted that the market would turn around as fast as it did and see 20% appreciation here for the last couple of years.

You could alleged that "protected clases" of people are more likely to be renters and that the HOA's "no rental" policy "has a discriminatory effect where it actually or predictably results in a disparate impact on a group of persons or creates, increases, reinforces, or perpetuates segregated housing patterns because of race, color, religion, sex, handicap, familial status, or national origin."
