Ask to speak with some of their current owners and current/former tenants.

General rule, speak to as many lenders and loan officers as you can, just because one institution tells you one thing does not necessarily mean that is the case for others.

Tenant A was MIA for a while and we started the eviction process until they finally paid up at the end.Tenant B hasn't paid any rent yet so I don't believe they are considered tenants just yet, if anything they would be tenants at sufferance.But you're right, we will likely have to speak to a lawyer at this point. 

Practically speaking,  these are 2 separate and distinct actions that most likely have to be undertaken.Much successBob 

My triplex is grandfathered in.I did speak to a few attorneys thus far and the conversation usually gets me to an agreement that I can do the subdivision by right but ends there.
