You have a contractual obligation, as opposed to a legal obligation, to tender the Earnest Money to the party listed as the Escrowee in the contract.

It was different in the 80s when interets rates were in the 15% range and a 10% seller financed deal made good sense to both parties.

But they have been a nightmare...not paying rent, throwing parties every night, trash everywhere.

I would expect anyone in obligations to in a contract to notify the other party of force majeure thereby setting up that negotiations are required to complete the contract. 

I have been showing them and have some interested parties but I’m concerned they might stop  paying after the first month.

We are able to cashflow the unit and that part is a success.

If I was guessing, I would say that there may not be a firm agreement inside the household on whether to move or not and sometimes if one party is less motivated than another, it causes deals to backfire for little things.
