Some of my tenants have tenant insurance, some don't.My mandatory rental property insurance (I'm using Square One) includes $1M Premises Liability which covers personal injury cases where the injury was caused by some type of unsafe or defective condition on my rental property.

I am not aware of a court ruling on this particular Code provision, but if I were a landlord I would not risk being on the wrong side of a “test case” where someone is injured badly.So, in the example above with an owner occupied two family with one common entrance and driveway, that lease provision would be illegal.Even if the tenant is responsible for snow removal under a legal lease provision, the landlord could still face personal injury liability for slip and falls on snow and ice under the SJC ruling.

If you're doing short-term corporate rentals, I could see tenants agreeing 0 guests.I see the benefit in limiting guests like you do too.More people = more wear and tear, more noise, more parking, more utilities, potential extra roommates or AIrnb rentals, more liability or more opportunity for injuries or mishaps, etc.
