I'm aware I won't be able to get a conventional loan with the IRS lien on the properties and that a certificate of discharge more than likely wouldn't happen.

Like you mentioned, you can even use it for Assisted living facilities (ALF) but an officer ( I think Fire marshall dept) will need to inspect and provide Certificate of occupancy.

. - City rental certifications can be required- There is certain paperwork that you need to give someone at the time of signing a lease with them (lead based paint       disclosure and pamphlet, inventory checklist, etc...)- If someone stops paying rent you may need to go through an eviction process- When screening tenants you need to do a thorough check of who you're renting to- There are several Fair Housing laws you need to be aware of when placing a tenantOften times, a PM company will even be able to cover their own cost by receiving the highest rental amount possible for your investment, most likely higher than you could by yourself due to the exposure and avenues they have for marketing.

If she doesn't get her certification and decides to break the lease courts could rule you rented the property under false pretenses,and decide she won't have to pay any fees for breaking it.

I have 229000 left on the current loan and I don’t believe I will be able to get more than that from a new construction loan.I believe I need to pay an attorney to get me out from underneath this guy and find someone to get this thing built to at least get a certificate of occupancy within the budget I have.
