We spoke and she said it would probably be better if I filed in court instead of her, since her filing would be an eviction to move the trailer, which my contract with the seller prohibits, plus he can’t afford to, whereas mine would just get me the trailer back.The tenant is really hard to get in touch with.

Hello Adam,It is my opinion and not legal adivce that what is an is not a Security for federal law is governed by the the howey test:investment of money due toan expectation of profits arising froma common enterprisewhich depends solely on the efforts of a promoter or third partyThe structure you propose triggers all four prongs therefore IS a security.As you rightly point out its probably cost prohibitive to take this down the syndication path.The best way in this case is to just create a member managed llc with all decision voted on by the members.

Our process went as follow:1) 2 reps from different title plants pull title for free (granted we already were giving them a great deal of business)2) A few days before or the day before the scheduled sale, We had an independent abstractor at the county recorders office do a final check before we bid.Unless you have very deep pockets or have a very narrow niche property you are targeting, paying for that many title reports in so many counties may be cost prohibitive.

You have to be an owner occupant to get a 203k, but there would be nothing that would prohibit you from getting conventional mortgages after that (I think the limit is about 10 for most banks depending on how they operate).
