The banks don't let anyone slide, and charge you an overdraft or late payment, but being new to the real estate game, is this along those lines as well? 

Also the date that Day 1 & the subsequent 21 day window are somewhat in question.

Either way, the new listing of the property and subsequent lease with the new tenant can be whatever rate you want and that the tenant will agree too (unless there's some local law or code capping that).Not a lawyer or PM.
