I do it differently then get my agreement blessed by judge (since I know many of the SO CAL probate judges, thus has become my standard way of doing business.

If they do that then even if they do not show up the judge could grant  a judgment in your favor at the eviction hearing. 

The schedule B Exceptions to be added include declarations of community.

I am not saying that you are one of those people but you have not given us anything to judge one way or the other.

About your specific scenario, it is hard to judge your Broker for his inability to get a quick response.  

Your community already declared you don't care!

I have read many suggestions in landlording books that it is smart to note every contact point one has with their tenants to help "paint a picture" for a judge if one had to go to court.  

The question is whether you want to go to court about it....who knows what a judge will say.  

So, to wrap up this long-winded reply, I'd say that you are the best judge of it.
