If someone pays me $125k in cash, I'm assuming it would just be a matter of getting the title transferred to him/her and then I'd be responsible for paying back my debt to the bank.

I've been getting mixed advice on setting up an LLC on the property and if so that I should do it prior to closing so I don't have to transfer.

I'm thinking that being able to transfer homes through arms length transactions could be benifitial.

All of my expenses (purchase, lot clearing, wire transfer fees, etc) were borne out of my HELOC, though I had the cash on hand.

If not, is it legal for me to transfer the LLC to my own name just to do the refinance and then transfer it back to the LLC?  

And then transfer ownership to LLC prior to renting out?
