Assuming that you are not a general contractor by trade, you can either gamble big money that a house is ok, or you can accept that you will lose an occasional deal to some maniac who doesn't want to do an inspection.

Send them a letter certified mail , let them know its your property and you reserve the right to tell them to remove the garden with 10 days notice .

There seems to be red flags all over the place and I will not enter in the actual contract or send any DD money until/unless this is resolved but since this my first time land-lording & buying a property I am here to find out what I can do while I am still able to negotiate a few things.
