The biggest and most threatening penalty I see today is that if you become one of the top 1% most expensive customers to your insurance company (i.e., you get really, really sick), there is a greater than 50% chance that your insurance company will dump you...That's the biggest risk...and the one that most needs to be fixed...

At that point it is no biggy to clean it up a bit and provide it along with the estimate or bid/ contract.IMO, contractors should provide their customers contracts that cover themselves AND their customers.
