If no changes then you are able to terminate the contract due to the agent not doing their fiduciary duties but, I would review the terms of the contract before considering termination.  

It is there legal duty to try and get as much as they can for the property in its current condition.

She has a fiduciary duty to the seller so I wouldn't expect her to be helpful to you as the buyer.
