As the seller, you can definitely throw a contingency to the buyer that if they don't get their documents squared away by ##/## date, you are going with the next best offer.

My point is that there are so many potentially dangerous unforeseen scenarios that could effect the two of you, that having a clear legal document should take priority in your evaluation of this "partnership".
