That will prevent some confusion with your loan officer.

A simple clause saying that "losing party pays all reasonable attorney fees and associated costs" can prevent someone from filing a frivolous lawsuit. 

We have it annually checked and treated for termites now as preventative maintenance and haven't had issues since.Termite damage doesn't have to be a deal breaker, but definitely do your research and take care during your due diligence period.
