we also replaced all the original windows and all the furnaces, putting in gas heat for each individual unit.Yes we also had that insul-brick (though around here it goes by a much more offensive nickname that I won't repeat).

Personally I'd eat the $75 for the "first offense" for something like this for a truly good tenant....... do you really expect a tenant to change the filter each month?.....

Ultimately it was your fault (or your CPA's fault) for not knowing the deadline, but if it is a first time offense occasionally the IRS will waive the penalty.It doesn't hurt to call and ask for the penalty abatement.
