 @Henry Perez, I'll add my two cents gleaned from owning about 1,700 C and B class units, some with pools and some without.Bottom line: when I'm deciding about buying a property with a pool, worry about liability usually has little place in the decision.

You can simply go to a title company pay 250 buck aroos for a title commitment.. in that title commitment it will answer all these questions then you tell the escrow officer what you want to happen.. and they will tell you what deeds need to be signed and recorded to get to were you want to be.but if it was a TIC and your pop had 50% and he deeded his 50% to wife.. then wife and your brother own it.. at least from what I can glean from your post.or you can blow a few grand with an attorney that will basically tell you the same thing a good escrow officer can tell you for a few hundred..
