Removing a verbal-agreement tenant can be very difficult - basically in this case the courts favor the tenants word over owner/landlord on almost everything if the tenant won't cooperate.  

Say for the sake of argument that they are offering a 2.5% split/broker cooperation. 

@Cooper Dunnavant This is one of a large number of reasons why people may opt for "commercial" loans on their BRRRRs as they scale. 

Brooke,It seems to me that the first person you need to contact is the property owner, and you need to convince him to cooperate with you.

In my experience, most of the foreclosed owners cooperate or at least engage in some sort of discussion with the new purchasers to figure out a dignified exit or perhaps a negotiated cash for keys scenario.With the recent purchase, I left various messages and posted letters at the front door asking for a call back to discuss the living arrangement.

I know he would not be especially cooperative with numerous people walking through due to COVID (one of the reasons I was thinking it was best to remove him).  

If you pay me $ by Friday, you can stayI'll give you $ if you leave the house by next week (cash for keys, I'd rather give a cooperating tenant $200-300 than a lawyer)Do nothing and sheriff puts belonging on the curb.The tenant is the one who picks the option. 

Tenants are already in and it was written in the lease that construction will be done and their cooperation needed in the process.
