The property that you sell and then purchase through a 1031 Exchange must be held for rental, investment (capital appreciation), or used in a business. 

Additionally, the borrower no longer has any income coming from the subject property during these proceedings.  

With an LLC, you may be able to deduct business expenses more effectively and avoid double taxation.

Did the proceeds from the sale count as short term or long term capital gains?
