The only option I see is to try to ease some of the tension, get them back to paying the original amount until courts open again where eviction is back on table. 

Any honest Title Company closing agent will pick up on this fact and refuse to close the deal at the table.  

You should not wait to have a deal on the closing table to form your LLC.

This way you'll be able to use an owner occupied loan (like FHA) which will help you come to the table with a lower down payment (especially in OC lol).
