My thought, and no I'm not an expert, is that modifying would involve more of a principle reduction versus rate reduction since most borrowers are underwater, or possibly a combination of both.

Right out of the gate, I'm crushing any other LO, Lender or Mortgage Broker as I'm $12,000 to 13,000 cheaper with the Realtor Rebate which can pay for my borrower's closing costs, be used to further reduce the negotiated sales price, used for debt reduction, used for Rate Buy Down, pre-paids, extend sales contracts, etc., etc.

Also, nothing in your purchase contract regagrding commission is enforcable.The listing agent seems to already be the prouring party.Since you've "already agreed on a price" any commission reduction wpuld simply stay in the seller's pocket anyway.When you start trying to dictate to a seller what and how a commission will be paid, you may just demand your way out of a deal.
