If this ends up in court your explanation should be sufficient and I would not be concerned. 

You can be caught and taken to court.

So keep in mind, you hire an attorney and have to pay him to handle the lawsuit and there is court costs.

However, this is one of those tread lightly types of scenarios because it's not always what your intent is, but what someone could make it seem like your intent was in court. 

The idea in an agreement like this is I get paid, the seller can get rid of the home, and we are not adding on attorney fees and court costs that serve on one. 

That is, if there are any issues during their tenancy, not result to litigation or a court case.
