I have no idea what kind of repairs/work will be needed until it is vacant.But yes, you need to check local laws, but you likely can keep the deposit to cover the repairs and such.

Then when I put it back on market I had to give concessions to get them rented like no security deposit and the rents were about 20% lower than they were in 2007.I'm fine with boom and bust as that's natural.

If the out going tenant puts multiple holes into the walls and therefore makes the property un-rent-able until the holes are fixed, is the out going tenant responsible for the loss in rent income ( 1 month) and can it be deducted from the Damage deposit.
