Talk to a lawyer and if they say yes, have everything written up so it is iron clad. 

First Step pf all I think that is to find a Title Company/ Real Estate Lawyer  that is familiar with the closing process.

I think it may be time to consult with a lawyer to get out of the contract I signed.

I'm no lawyer, so no legal advice here, but it seams to me the tenant DID report the problem so he fulfilled his obligation.  

I have one friend that has a structure like this that his lawyer set up without any thought to how to manage it.
