Based on todays interest rates for every dollar of dead equity in a property you are losing 5% annually.Dead equity is the most ultra conservative approach to real estate investing and reduces your ROI to below the most conservative returnes.

Also keep in mind that in Illinois, typically attorneys handle title clearance so they are very involved with the process. 

Unless your site/situation has unique or special circumstances that do not generally apply to similar projects, it may be difficult to successfully argue that you should be allowed to have reduced setbacks when others in similar situations can't.
