Because the apartment is poorly insulated, we winterize the apartment, shut off the water, and close it down for the winter months. 

Just shutting a business down does not usually remove obligations off of a lease.

I've always declined; not because I have an HOA to deal with but because in my area there have been a number of unlicensed assisted living facilities being run out of rentals until they are finally shut down when someone reports elder abuse. 

Although it will be shut down again mid April for a new kitchen.
