Somewhere along the line someone's going to have accomplished their goals and retire, decide they're sick of one-off deals and start doing apartment complexes or entire portfolios of retiring REI, get divorced, be sick of making payments and stop expanding while they pay the mortgages off (another great way to bump cashflow without taking on additional tenants that you have to babysit), get fed up with residential loans and start using commercial, get into syndication, decide to diversify and put more in Wall Street, buy furnished rental units in Baja, California, start doing hotels and reality TV and the like and eventually become elected President of the United States, etc etc.

Due to the capital gains I know it's more tax advantageous to elect the S-Corp tax structure.I'm assuming you wouldn't want to have a flip under the same LLC as a rental since they should be taxed differently.Should I set up one LLC (elected to be taxed as an S-Corp) strictly for my flips and separate LLC's for each rental?

So, De minimis is always better than section 179 or bonus 50% depreciation.The “de minimis safe harbor election” may be particularly useful when it comes to year-end planning, as it is available for qualifying assets even if they are bought and placed in service near the close of the taxpayer's tax year.If you are over the limit of 2500, the bonus depreciation (50%) is better than section 179 because there is no phase-out.Bonus depreciation is changing to 100% next year but we should always use de minimis because its an expense compared to depreciation that is subject to recapture.Change passive activity to non-passive:Step up material participation hoursSale of passive activity: If a you dispose of your entire interest in a passive activity in a fully-taxable transaction, than any loss from the activity for the tax year of disposition (including losses carried over from earlier years) will be non-passive.

I am reading on the safe harbor rule, and it appears quite limited in it's application.To take this election: Your gross receipts, including all your other income, are $10,000,000 or less.Your eligible building has an unadjusted basis of $1,000,000 or less.The cost of all repairs, maintenance and improvements is less than or equal to the smallest of these limits: 2% of the unadjusted basis of your building or$10,000The hangup I have is 2% of the building's basis.

In the event a problem occurs I open a trouble ticket online and they handle the dispatch.If the nature of the problem is outside of what's covered by the warranty companies, then, I make calls to local plumbers, electricians, contractors, exterminator or whomever is needed to get the job done.All of these are people/companies who have worked for me and know of my credibility to pay for their service on time, so, they readily take care of the problem until I return.The bottom line is that I elected to run the business on my own and it doesn't consume all of my time whether I am home or abroad and there is no impact to service with my handling of it this way.Lastly, my conclusion is that this method of handling the business is successful, because I take care of all issues promptly and don't allow them to mount and escalate into an emergency.
