Technically you can make an excuse like check smoke alarm batteries, replace furnace filter, etc., but a determined tenant could push back on that too and say that they will tend to those things.

Get a good lawyer immediately.California hates landlords and loves poor tenants with personal problems.Yes,she can sue you and probably will win a settlement from you after driving you insane first.Doubt she can prove that air conditioning had anything to do with his condition but,California judges like to look for any excuse to favor tenants.Good luck to you.

Either way, it seems like answer to your problem unless you aren't charging an application fee in which case taking that money out of pocket for an excuse to reject them seems silly.
